1) Introduction
This website is operated by GardenEco. When using, accessing or buying from our website you agree to be legally bound by these Terms and Conditions. We reserve the right to change these terms and conditions at any time. Please ensure you read thoroughly our conditions on each visit to our website. Visits to our website will signify that you are willing to be bound by the most up to date terms and conditions as listed on our website. We reserve the right to change our terms and conditions at any time without notice. By confirming your order you will have deemed to consent to our terms and condition. We advise that you read carefully the terms and conditions print and retain for your records.
These terms and conditions are for private individuals only. If you are buying our goods to re-sell on then you must notify us in writing to open a trade account with us. We define a consumer as any person who, in buying something to which the Consumer Protection (Distance Selling Regulations) 2000 apply, is acting for purposes outside their business. We will not be held liable for any consequential loss when selling to a third party.

2) Product Information General
All dimensions stated are approximate and based on the outer external measurements. Please make allowances for such additional measurements such as roof or log overhang subject to your installation requirements and/or wall thickness.
All Images, videos and all other forms of Illustration are to demonstrate a product and support the product text or description only. Timber treatments and other accessories where shown are not included unless stated in the product text.
These terms and conditions apply to the contract between us for supply of goods / services ordered by you and described in the sales order.
Before you purchase please ensure that you have read and fully understood our Terms and Conditions and that you are satisfied with the description of our products and the service we offer.

We reserve the right to assign, transfer, or subcontract part or all of our rights and obligations under these terms and conditions at any time.

We may alter these terms and conditions from time to time. Our website will reflect our most up to date terms and conditions at any time. We advise that you check the terms and conditions on the website each visit to our site.

Our terms and conditions and privacy policy together with any order and payment method instructions act as the sole agreement between you as the customer and us as the retailer.

These terms and conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court. GardenEco will not be held liable for any failure to perform any payment obligation due to causes beyond your or Gardeneco’s control

If any provision or terms of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them. Failure or delay by either party enforcing an obligation or exercising a right under these Terms and Conditions does not constitute a waive of that obligation or right.

Our terms and conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999. Please note that our website is available only to individuals that can form legally binding contracts under applicable law. You must be over 18 years to purchase the Products, using the payment methods displayed on our website. If you do not qualify we ask that do not use our website.

GardenEco shall be under no liability for any delay or failure to deliver products directly or indirectly by circumstances beyond its reasonable control.

Gardeneco’s liability for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for your order. This is applicable in respect of one incident or series of incidents attributable to the same cause. This does not affect your statutory rights.

4) Security
We are committed to ensuring your information is secure.

In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect from you online.

100% secure online ordering
When ordering on line there is no doubt that sensitive information will be passed to us. When browsing you will see a padlock at the bottom of your browser window and may see a popup window telling you that you are entering a secure area.

Clicking on the padlock will give you further information about the secure area where your credit card details are processed and encrypted. This certificate can only be signed by trusted organisations and guarantees a high level of security. For your comfort our customer service personnel are only a phone call or email away.

You are responsible in all respects for all use of and for protecting the confidentiality of any username, email verification and password. It is your responsibility not to share any of these confidential details with or transfer them to any third parties. You must notify us immediately in writing if you feel there has or maybe a breach of security regarding our website.

Credit Card Security

Our form pages are secured using High Level 128-bit SSL Encryption. Credit card payments are processed by Protx using secure servers. All credit card numbers are encrypted in the software when the order is placed and are only decrypted after they reach our computer. They are not held in clear text on any web site.
We will seek to verify all card transactions against the delivery address. We cannot process any payments from cards not registered to the delivery address. 

5) Ordering

If you are an Existing Customer
If you are an existing customer, then you will be asked to verify your email address and password.

You can easily and safely place an order and purchase goods online. Our site utilizes the highly secure Protx payment system with 3D for added security. Simply select the items you would like to order adding them to your shopping basket. When you have finished shopping you can proceed to the checkout, where you will be asked to fill in your payment details. You can view the items in your shopping cart at any time, making changes to your order where required. Any personal information given will be used only by us for the purpose of processing your order.

We accept VISA, Master Card, Debit Cards and Personal Cheques.

Alternatively, you can telephone us on 01400 270075 or even post your order to us. For your convenience you can leave your best telephone contact number and state a time that would be convenient for us to contact. We can then confirm the details of your order and arrange delivery.

6) The Price and the Payment

The price of the goods shall be the price as set out on our website. We reserve the right to change price set out on the site without prior notice. Following the acceptance of your order. The price of your goods will be set out in a reasonable range at the time the order is placed.
The price of your purchase or product is subject to an additional charge if delivery is not completed within 2 months of order date, due to delays by customer.
 
Payment is made by credit or debit card when we receive your order. We accept Switch, Solo MasterCard, Visa, Delta, American Express or Maestro. We can also take payment via bank transfer.

With card payments, due to our method of Address Verification, we are only able to deliver to the cardholders’ address. Full payment must be made before any items will be delivered.

Cheques given by you to us in payment shall not be treated as payment until the cheque has fully cleared with the bank. Please allow up to 8 working days for any cheques to clear and 3 to 5 working days for bank transfers.
 
 
The balance of the price agreed must be paid 48 hours prior to the agreed delivery date. (Cheque or credit card) date. 

Cheques
All cheques must be received at least 5 days before this date. If we are installing, the installation is to be paid directly to the fitter. The Installation of your cabin does not include us levelling the base or removing anything on the area the cabin needs to be installed. If the base is not fully in place prior to the installation team arriving a re-delivery or storage charge may be applied to your

Prices match
Prices listed are in Pounds Sterling and are inclusive of Delivery costs and VAT. Any additional delivery charges or additional costs will be clearly listed on the site. We reserve the right to change the advertised price of a Product at any time. The price you pay will be the price at the time of your order.

We will endeavour to match the price of any like-for-like Product you find on-line. If you find the same Product cheaper elsewhere please email us at pricematch@gardeneco.co.uk  and ask for a price match.

GardenEco reserves the rights to refuse any order placed by you. Orders placed on our website will be subject to acceptance in accordance with our terms and conditions.

9) Availability and Description
Our product range is constantly being updated and changing.  Our products are available almost everywhere in mainland UK. By special arrangement we can deliver to the Outlying areas of mainland UK, Channel Islands, Republic of Ireland, Isle of Wight, Isle of Man and the Scottish Highlands & Off shore Islands.

All of our products are subject to availability. If the product you order is unavailable at the time of purchase we may provide you with a substitute of an equivalent quality and value without notice. If we do not have the product or a relevant substitute we will contact you to discuss. We reserve the right not to supply you at our discretion.

Products featured on our web site may be known by a different model number or brand name. Some items may vary slightly cosmetically. We reserve the right to supply these as the products listed on our web site. If you are in any doubts or worries please speak to us before placing your order.

Manufacturers will from time to time update their products, and we reserve the right to supply these to fulfil your order.

Pictures and illustrations are for illustration purposes only. Products may occasionally vary in size, shape, texture or colour. All sizes are approximate.

The GardenEco spend considerable time ensuring all advertised sizes and measurements accurate but these sizes and dimensions must be taken as approximations. Please contact us on info@gardeneco.co.uk   is you require further information regarding sizes and dimensions.

The Goods
We shall sell you goods which you shall purchase only the goods which you have set out and confirmed in an order. Confirmation of this order will then be accepted by us and confirmed with an email or other correspondance. We reserve the right to reject any order.  Any advice, recommendation or other given by this website or other media is given by us or agent, employee or other is accepted at your own risk and accordingly we shall not be liable for any such advice or recommendation. Any typographical, clerical, omission or other error on this website, written media, quotation, price list, invoice, acceptance of offer, information or other document issued by us shall be subject to change or correction without prior notice without any liability on our part.
 
 
The goods you have purchased may be a Natural ‘Living’ Wooden product and some slight variation in knots or splits may occur. This in no way affects the fitness for purpose or stability of the goods. Please check our timber movement guidelines.

10) Cancellations and Returns
Gardeneco’s cancellation / returns policy:-

Should for any reason you not happy with your purchase from us we operate a strict returns policy. Providing you have not used the product, notified us within 7 days of your purchase, we shall refund all monies paid less a charge to cover the cost of carriage, payment processing and restocking.

The product must be returned in its original packaging with all of the instructions and parts supplied.

If your purchase or the packaging is damaged or found to be faulty within 7 days of purchase, we will of course replace the item at no extra charge or you will be offered a full refund and the item collected. We would add that this is subject to GardenEco being completely satisfied that the item damage has been caused during transit. The delivery note must be signed stating that the item has not "not checked" or similar. This is to ensure that it is faulty workmanship and is not the result of customer abuse or mishandling. This does not affect your statutory rights.

Right to Cancel

Cancellations before Dispatch
If you wish to cancel your order before dispatch, please email us at info@gardeneco.co.uk  or call 01400270075

You may cancel your Order up to 48 hours before dispatch. Your order will not be considered cancelled until notification in writing is received at cancellations@gardeneco.co.uk  and acknowledged by us.

What if a product is out of stock?
On the rare occasions when an item is ordered and is out of stock, we will notify you as soon as possible. We will endeavour to find a suitable replacement at your approval.

If this is not possible, we will reimburse your payment in full.

Back Orders

If your item is not in stock, we will back order for you. You will always be telephoned with the option to cancel your order if you would rather not wait.

Cancellations after Dispatch
If you decide to cancel an order after the product(s) have been to you please email us at info@gardeneco.co.uk. If the delivery has left we may, at our discretion, charge you for the return carriage of those goods. This will be deducted from any refund issued.

Cancellations after Order for Large or specialist Buildings
Log Cabin and Garden Buildings will generally be ordered for you and just for you. Should you cancel your cabin delivery , for whatever reason ,  that has been personalised for you whilst it is on route from the factory to a hub, waiting in a hub for delivery or on route to your property you will be charge. The charge will be a minimum of £250 to cover the specialist hi-ab crane delivery and driver costs. This cost is unavoidable due to the  personalised  picking and packing of your cabin just for you. Each cabin is customised for you and cannot be cancelled once on route. Should you wish to cancel your delivery after ordering as part of your statuary rights you may but, must pay for the cost of return back to the original source. There will be no restocking charge, only the cost of return. Should you wish to do this, this cost will be confirmed in writing and taken from your refund.

We recommend that you check the status of your order before you request a cancellation. 

Change of Mind Returns (Cooling Off Period)
You may return any delivered product(s) you have purchased within 7 working days after day of delivery for any reason to do so you must notify us in writing via email to info@gardeneco.co.uk  or via the postal system.

All returned products must be returned in the original packaging in the condition they were delivered, if you have opened the package you must have done so without damaging or marking the product. All items are to be returned within 30 days of cancellation. On there return all products will be thoroughly checked and we reserve the right to only offer partial refund should the item or the packaging be damaged making it unsalable as a new item. For parcel returns you will be expected to return at your cost in the same condition they were delivered unless of course the item is found to be faulty.

Item is faulty after 14 days
If the product becomes defective after 14 days (or more) it will be assumed that a satisfactory acceptance of the goods has taken place. We would recommend that you stop using the goods immediately. GARDENECO may choose to repair the product by the issuing you the necessary replacement parts or chose to replace the product in its entirety or refund you. At our discretion, we may charge you for the return of a product if it the item proves not to be faulty. This does not affect your statutory rights. We would not be charged for the cost of returning a defective product.

Refunds
Refunds are subject to a fee covering any costs incurred by the Company, such as Administration fees, card fees, etc. Refunds are usually processed within 30 days. Before you request or arrange the return of a product, please read the information below carefully. Please note that if applicable, all parts must be checked by you, before assembly to make sure they are all there and that you are happy with the quality, once fully assembled has been commenced the purchase price cannot be refunded.

Special conditions regarding returns
We will not accept returns or cancellations if the product(s) have been altered by applying chemicals, paints, stains or other chemicals to surface(s). In addition to this we will not accept returns that have been customised, altered in any way other than the manufacturer’s standards. Any alterations such as these would be deemed as you using or treating the products as your own. 

Wooden Buildings Product Returns Policy
We do not accept the return of any dispatched cabins for shortages of boards, any damage in transit or naturally split boards etc. Please note that, wood is a living product. Being a natural product wood will react to changes in atmospheric conditions. Cracks, Shakes, and Fissures may occur as timber dries, expands and contracts with changes of humidity and temperature.

This is perfectly natural and does not affect the integrity of the timber or of the structure it is used in. Despite technical drying methods it is, nonetheless, impossible to completely prevent some degree of warping and the formation of resin and cracks, especially on the outside surfaces.

11) Warranties and guarantee
Your statutory rights are not affected by these conditions.

We work alongside our suppliers and retailers who offer their own product warranties and guarantees. These vary and our listings will generally show what warranty or guarantee applies to the product. Should you be unsure of exactly what they are and need help then please contact our Customer Care Team at customercare@gardeneco.co.uk  

Log Cabin Warranty
Subject to proper installation and normal residential use.
Generally Log Cabins carry a 10 year warranty on all Pressure Treated Wooden component parts against fungal decay and damage by insects. All other timbers carry a 10 year warranty as long as they have been treated with a quality preserver and treated annually.
 
Timber is a natural product. Cracks, Shakes, and Fissures may occur as timber dries; this is a normal process and does not affect the overall strength and durability of the timber. The timber will change colour over time and may also contain Knots and Knot Holes. These are not covered by the warranty as these naturally occur in all pressure treated wood.
 
GardenEco reserves the right to examine photographs of products claimed to be defective. Products must only be returned through our normal procedure.
 
This Warranty covers the replacement of these goods and may not cover any travel expenses, lost wages, or labour costs, involved in the installation or replacement of the parts. Your warranty may be void if the products are seen to have been subjected to abuse, acts of God, negligence, adaptations or improper use.

12) Risk and Property
Any risk of damage to or loss of the goods shall transfer to you (the customer) at the time of delivery or, if you wrongfully fail to take delivery of the goods at the time when we or the carrier has tendered delivery of the goods. Special delivery instructions should be added when placing your order. Failure to do this may incur a re-delivery charge. For clarity the ownership will not pass you the customer until we receive the cash or cleared funds payment in full for the goods supplied to you. Good supplied to you are not for resale.

Web site price errors

The price on your order will be noted by us as on your confirmation email or over the phone. We endeavour to ensure prices displayed on our website are correct at all times. Should a Pricing error arise we will contact you and you may choose to either proceed with or Cancel the Order.

Tax Charges: - VAT is included in the prices quoted at 17.5 %.

GardenEco makes no representations whatsoever about any other websites which you may access through our website or which may link to our website. Other websites are independent from us and that we have no control over the content or availability of that website.

GardenEco accepts no responsibility for the content, or the use of, such a website. GardenEco shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use or reliance on any content.

Any concerns regarding any external link should be directed to its website administrator or web master. 


17) Availability and use of our Website
We make our best endeavours to ensure our website is available. We cannot guarantee that our website will operate continuously, without interruptions or is error free. We accept no liability for its unavailability.

You must not attempt to interfere with the proper working of our website in any way.

We accept no liability for any indirect, consequential loss, damage , special damages, punitive damages or costs for any loss of data, profit, revenue or business contracts (whether direct or indirect)

Our website operated from our offices in England. In certain circumstances content published on our website is supplied by third parties. This content is outside of our control and we do not endorse such content in any way.

GardenEco makes no representations and gives no warranties, express or implied that making the Products available in any particular jurisdiction outside the UK is permitted under any applicable non-UK laws or regulations. Accordingly, if making the Products or any part available in your jurisdiction or to you (by reason of nationality, residence or otherwise) is prohibited, those Products are not offered for sale to you.

We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it. Whilst changes are being made we accept no liabilities for any loss or damage.

These terms and conditions replace all other terms and conditions previously applicable to the use of our website and/or sale of the product(s).
